"Do I really have to read it all?"

Without a clear understanding of professional expectations, miscommunications and subsequent financial loss
or other sad situations may result, in spite of our best efforts at friendly resolution.  If you feel these requirements are excessive,
Holistic Dynamic may not be a good fit for your needs.  Read thoroughly, and ask for clarification at ANY time.

All Room Use - Basic Terms:

General
  • Your signature on these terms & accurate contact info are required before regular use of the studio space may occur.  Honor our agreements and policies as you would those of any professional workplace.  Consistent disregard for policy and/or procedure will result in revocation of privileges.
  • This is not a rental or lease agreement, and unauthorized or inappropriate use of the space will not be tolerated.  Space & equipment is provided for your use as a convenient service (not a right), and is subject to availability & restrictions.  Change or cancelation of your reservations may be made by HD for any reason, and at any time; but we would only do so after careful consideration.
  • A deposit is required to secure your reservation. Cancelation terms are described on our Request Studio Time form.  Bulk deposits are encouraged for recurring or frequent bookings, and actual room use fees can be deducted as needed.
  • Space is provided on either a full service or unsupervised basis.  Unsupervised participants are subject to additional terms (more info below).
  • We reserve the right to request references and/or run a background check on any user at any time.
  • The user of the space (referred to as user/you in this document) works independently, and is not employed by nor partnered with Holistic Dynamic, Inc (HD) or Ginger Marcus.
    • You manage your own bookings and/or business affairs; including, but not limited to IRS reporting.  HD keeps simple sales records of your paid room use - email your request for an end-of-year electronic statement by December 31, and allow 30 days for processing.
    • HD will not be held financially liable for unforeseen/unintentional circumstances which interfere with normal operations, such as scheduling conflicts, power outages, acts of nature (including those which affect safe travel or studio operation), etc.
    • You are financially responsible for timely payment to repair any damages caused by your activities or clients.  This may need to be negotiated directly with the landlord of HD's rental property.
    • Contact Ginger immediately if you wish to cancel your participation so we can finalize account balances or other loose ends.
  • Terms, procedures, and rates are subject to change as needed and without notice, and renewal will be required when changes affecting your participation arise (currently about 3-4x/year).  Scheduling room use indicates you agree to the current and updated terms posted on this page, and you are expected to review the site from time to time on your own to stay up to date.
  • A free orientation & training is required for regular use.  This is time to address questions/concerns about procedures & how we'll work together.  Orientations may be done as a group; and updates are occasionally necessary.
  • Review our posted Notices/Disclaimers for studio clients on Practitioner Family page.
Liability & Professional Conduct
  • When using the studio space, you must maintain your required licensing & updates, and adhere to any practice & ethical standards required by law and/or your profession.
  • When licensing is applicable, a current copy must be displayed for guests while you are working.
  • If any question is raised about the appropriateness or legality of your conduct, your activities & access may be immediately suspended while the matter is investigated.
  • You may not gather guests' personal data from HDs databases without approval from and disclosure to the guest.
  • Practitioners should carry portable liability insurance to cover self and clients through Hands On Trade Association, or the provider of your choice.  Some practitioners who cannot produce proof of insurance will sign a waiver before beginning work at the studio.
What I Also Provide (Ginger & Holistic Dynamic/HD)
  • Orientation & training on studio procedures, equipment use, etc.; plus ongoing updates; and refreshers on request.
  • With advance reservation, use of basic equipment such as massage table, music, table/chairs, etc. for your scheduled activity; subject to availability and occasional additional fees.
  • Maintenance of the master schedule on Google Calendar, for your convenient reference.
  • Pre-payment option for anticipated room use fees - see Payment procedures for details.
  • HD can accept the occasional electronic payment from your guests on your behalf; less a 5% administrative fee.  The remaining money will be held as a credit on your account, which expires in 6 months per our posted refund policy.
  • Normal office management:  Rent, building insurance, utilities (lights, heat, air conditioning, etc); liaison with condo association.  Plus basics like filtered or bottled water, tissues, trash bags, restroom supplies, general upkeep.
  • Options based on your participation level:  web page on HD's site, social media blasts, expo space & other vendor opportunities, open houses, etc (some options will incur an additional cost).
  • Selective cross-advertising promotions when appropriate - inquire for more information.
  • Full time commitment to the success of the studio as a whole.
What You Also Provide (User)
  • Time for an initial interview with Ginger, to define how we will work together.  A free quick demo of your service(s), products, or presentations may be required (on request only).
  • Same day or pre-payment of all room use fees, and timely payment of deposits and any other charges.
  • Ample notice of schedule changes/cancelations, including late arrival, and other last minute changes.
  • Treat studio spaces like your own home, or better.  Our guests deserve a clean, neat space to enjoy.  This means straightening up after each room use - empty the trash can in your room, tidy the restroom, vacuum visible dirt, and whatever else needs doing.  Remember that someone else may be using the studio immediately after you, so leave it looking good for them.
  • Other equipment needed for your room use, including your own tables or massage table in case ours are already reserved.
  • Practitioners:  Bring your own client linens - we cannot offer laundry service.  If you forget, you may take one disposable sheet & face cradle cover.  If you use more than one set, add $2 each for sheets and/or $.50 each for face cradle covers to your day's payment.
  • Safe operation of in-house & other equipment by you and your clients - HD will not be held liable for damages or injury.  Request manufacturers' directions and/or a demonstration of safe practices before using unfamiliar equipment.
  • If you forget a payment, notify HD immediately.  Unpaid and/or ignored invoices over 30 days are subject to late fees, collection action & associated fees/legal costs; and you may be required to pre-pay for all room use; or your privileges may simply be terminated.
  • Read emails and Subscribe to HDs Practitioner Network newsletters - they often contain announcements vital to use of the space.
More on Using the Space
  • Familiarize yourself with and honor the basic studio procedures Here ("right click" or Ctrl click if you want to open in a new window or tab)
  • Whole office booking may require an additional fee, depending on timing - inquire in advance.
  • Get permission before leaving personal items at the studio - our storage space is very limited.
  • Messy events and activities require advance notice, plus a drop cloth or other special precautions.  Ex. Foot bath, use of dripping oils, art projects, food demonstrations, etc.
  • You and your guests should eat your food (esp. staining or wet foods) in the hallway areas or in Room 3, and not over the nicer carpet in the front studio areas.  Clean up after yourself & clients, and take food trash to the dumpster on the same day to avoid critters and odors.
  • Loud noises such as drumming, yelling, and blaring music are only permitted under certain pre-negotiated circumstances out of respect for our neighbors in the office park.  Most loud events will require booking the entire office.
  • Do not use the following in the space:
    • Soy/"scented"/chemical-based products eg. incense, sprays, lotions, candles (most candles are made from paraffin, which is mildly toxic when burned).  We are a chemical-free zone, to the degree we can manage it.  Pure essential oils are fine.  Beeswax/palm wax candles and clean incense are available with your paid room use at no extra charge.  Ask what we can do to accommodate your needs
    • Charcoal discs are prohibited.  Go light on sage/smudge and other really smoky stuff - our fabrics in the retail store will smell like smoke after just a few minutes of use.
    • Alcohol - I know many of you enjoy a glass of wine and may want to bring some to HD to share...  Please don't bring it in the building.  Exceptions may be made for ceremonial purposes, but only with prior approval.
    • Glitter... and other highly trackable/spreadable stuff that everyone knows NEVER comes out of the carpet.
Unsupervised Use of the Studio - Additional Terms
  • Unsupervised access to the studio is a customized feature and granted on an as needed basis - it is not a guaranteed privilege.
  • Demonstration of open/close task proficiency is required before you work alone, and HD reserves the right to revoke access at any time.
  • Duties include (not limited to):  Clean up your room & common areas (including trash), reset furniture & equipment layouts, and otherwise maintain the studio according to terms and procedures presented here, and on This Page.  When procedures are honored, and after a trial period, studio use fees may be reduced, since you are taking some of the work burden (thank you).
  • If you run events that HD endorses, have new guests sign in on arrival, using the general waiver provided.  Their email is optional, but our waiver explains our expectations regarding HD's conduct and billing, and is not optional for new studio guests.
  • Practice strict fire safety habits!  Candles need an appropriate non-flammable, no-spill, wax-proof base; and fully extinguish all hot stuff and dispose of cold ash before you leave.  If it is discovered that your fire-safety habits are less than strict, you will be prohibited from using open flame in the studio in the future.
  • When you sell our retail items, HD will calculate 2% of each sale as a discount on your future room use fees; available in $5.00 increments.
  • All payments, counter sales, daily log forms, suggestions, etc go in the drop box when Ginger is not there to accept them.
Limits of Advertising & PR
  • To avoid misunderstandings, do not position yourself as a representative of Holistic Dynamic, even at HD sponsored events (this includes, but is not limited to use of the word "WE" in conversations).  If you are a listed studio affiliate, you are invited to align yourself with HD on a peer level, and always refer administrative matters to Ginger or another currently authorized HD representative.
  • HD will often advertise like-minded, related services & events within the scope of normal operations, but will not bear the responsibility of filling seats or sessions for you, even if you're coming from out of town; unless additional advertising services are purchased well in advance, which may then be fully or partially outsourced by HD to a local agency or studio affiliate.  This means you should be prepared to advertise your events and services on your own time, and using your own creative channels of client attraction.
Energy & Time Management
  • Professional services:
    • Minimize Brain-Picking:  All providers reserve the right to request, at any point in a conversation, that matters requiring training and expertise be treated as a paid service.  In turn, be prepared to offer payment (or trade) for professional-grade assistance provided to you while on studio grounds.  No one is expected to give away services for free - invite potential clients into your paid practice.
    • Co-operate:  Our guests are all free to engage in services and activities with other practitioners.  There may be several same or similar modalities here - if feelings of competition arise, notify Ginger immediately so we can work it out.
  • Professional time:
    • Avoid Got-A-Minute Meetings: Schedule ahead for business discussions, to avoid squeezing time.  Also, unexpected phone calls to HD are often replied to via email or text, which may include an offer to book a phone or in-person meeting.  If you do not leave a message, Ginger will not generally call you back.
    • Punctuality: Arrive early, and be prepared to start and end your own sessions & events on time out of respect for both studio and guest schedules.  If you are running late, notify us as soon as possible with details.
    • Stay in the Zone: Our automatic 30 min buffer allows about 15 min each for transitions.  If you need more time to set up or clear out of a room, let us know in advance (flat fee may be added).  If you do not need the extra time between, let us know.
    • Hanging out at the studio:  If you want to drop in for a spell while we're "open", please know you are welcome.  If you will be joining us for a extended period of time, consider helping with some simple tasks while we visit (dusting, pricing merchandise, restocking, etc).
  • Optional Referral Courtesy:  If you find you were referred to a new long term client, by HD’s active advertising efforts (stuff that requires [wo]manpower and/or money), and you choose to see that client elsewhere, it would be kind of you to make a one-time referral donation or do something else for HD to help recoup time/costs of advertising on your behalf.  This is a volunteered courtesy that can be extended to all supporters who take the time to promote for you.

Practitioner Family Terms
Additional agreements between affiliates and Holistic Dynamic - by invitation only
What we expect from our affiliates, as well as what we will provide to you when you participate in this capacity.  We are stronger together.

General
  • These terms may change without notice, so plan to review from time to time.  An updated signature will be required when the changes affect your participation with the studio.
  • Practitioner Family can be defined as dedicated, holistic-minded, professional providers of services or products, who are currently active in our studio community, and who work in alignment with our values and mission.
    • HD reserves the right to deny or revoke the Practitioner Family status at any time, for any reason and without advance notice.
    • As Practitioner Family, you may represent your own practice/business as a separate entity affiliated with HD.  Please refrain from using language that may identify you as an employee, manager, or decision maker at the studio.
    • HD reserves the right to ask that your participation or product line be customized to the HD studio, since we are endorsing you.  An example might be when a service provider has just one service, out of many offered, that we do not want performed on studio grounds, or a product that is undesirable for whatever reason.
    • Most participants who work regularly from HD, do some volunteer work or advertising, or show other beneficial active participation in our growth and success can easily maintain standing as “Practitioner Family”.  Privileges are lost after about 3 months of absence or inactivity, at Ginger's discretion.  An email notice is sent giving about 30 days to reactivate or move back to the Extended Network (you may simply reapply to be listed again).  After deactivation, promotional materials are either moved or disposed of.
What I provide in addition to the basic terms
  • Rapid booking via text or email.
  • No room deposit for unsupervised client sessions (deposit is still required for events).
  • You may work in exchange for some fees - tasks should be pre-negotiated and completed some time before room use.
  • You may submit content for facebook, blog or newsletter.  Content is subject to edit & approval, which may take some time - please send your material well in advance of the date you would like to see it published.

What you provide in addition to the basic terms
  • Up to date profile information for our website (below - ASAP), and up-to-date contact information for our records.
  • A return link from your website to our website.  Most folks link to their own HD page.
  • Show up for your agreed presentations, shifts, or vendor slots at HD Sponsored events.  Arrive early and/or be prepared to present your material on time, and end on time.
    • If you really have more important things to do, and can’t make it, help us find someone to fill in for you.  In the event that a suitable replacement cannot be found in time, Ginger reserves the right to fill in.
    • Regular cancelation or tardy arrival may result in your event participation being limited or discontinued.
  • Commitment to the quality, development, and success of your own practice or product.  If this work is more of a hobby for you, consider joining as an Extended Network participant.
  • Investment in the success of Holistic Dynamic.  I know it’s not your baby, but it is kind of like your adopted mama - treat her right, and she can help you grow.
  • Candid feedback - we need to know what is working, as well as what is not, in order to succeed together.
